Diese Aussage ist falsch, CETA wird nicht deshalb abgelehnt, weil es mit TTIP verwechselt wird, sondern weil es ein schlechtes Abkommen ist, das nicht nur dem Kulturbereich, sollte es ratifiziert werden, massiven Schaden zufügen würde.
In einem wesentlichen Punkt unterscheiden sich TTIP und CETA von bisherigen internationalen Handelsabkommen. Wurde bislang festgelegt, in welchen Bereichen eine Liberalisierung vorgesehen ist, also eine Positivliste erstellt, wird nun nach dem Negativlistenprinzip gearbeitet. Das heißt, dass zunächst alle Bereiche von der Liberalisierung erfasst werden, es sei denn, sie sind auf einer Negativliste verzeichnet, also ausgenommen. Die EU-Kommission betont stets, dass der Wechsel von Positiv- zu Negativlisten rein technischer Natur ist und keinen Einfluss auf das Schutzniveau hat. Der Kulturbereich ist ein Beispiel dafür, dass dies nicht stimmt. Bei Positivlistenverhandlungen müssen die Kulturbereiche, die mitverhandelt werden, dezidiert genannt werden. Bei Negativlistenverhandlungen, also CETA und auch TTIP, sind alle Kulturbereiche automatisch Verhandlungsgegenstand, außer sie werden rechtssicher ausgenommen, was schon deshalb sehr schwer ist, weil der dynamische Kulturbereich sich einfachen Definitionen regelmäßig entzieht. Aber ohne eine klare Abgrenzung der Ausnahmebereiche ist eine rechtssichere Herausnahme aus den Verträgen nicht möglich. CETA ist deshalb ein kulturpolitischer Sündenfall – mit letztlich unkalkulierbaren Auswirkungen für den Kulturbereich in der Zukunft. (…)
