Private Schiedsgerichte sind einer der umstrittensten Punkte in den geplanten Freihandelsabkommen zwischen der Europäischen Union und Kanada (CETA) beziehungsweise mit den USA (TTIP): Schiedsgerichte, die über vermeintliche Vertragsverletzungen urteilen sollen. Klagen können ausschließlich Unternehmen – wenn sie ihre Investitionen auf der jeweils anderen Seite des Atlantiks entwertet sehen, beispielsweise durch schärfere Umwelt- oder Sozialgesetze. Verklagt werden Staaten, oft auf Schadenersatz in mehrstelliger Millionen- oder sogar Milliardenhöhe. Als “Richter” fungieren Privatleute, meist Juristen aus großen internationalen Anwaltskanzleien. Die Verhandlungen werden, anders als Prozesse vor ordentlichen staatlichen Gerichten, nicht grundsätzlich öffentlich geführt. Eine Berufungsinstanz gibt es nicht.
